On June 9, 2022, Gov. JB Pritzker signed the Family Bereavement Act, an amendment to the Illinois Child Bereavement Act. This amendment requires Illinois employers to provide two weeks of unpaid leave to employees who experience a miscarriage, stillbirth, unsuccessful assisted reproductive procedure, failed adoption match or surrogacy arrangement, or other diagnosis affecting fertility. Employees may also use such unpaid leave to support a spouse or partner experiencing one of the foregoing.

Illinois employers should update their leave policies to reflect the new law. If you need assistance in doing so, or for a comprehensive review and assessment of your company’s policies or handbook, please reach out to me, or one of my colleagues, at Rathje Woodward LLC 630-668-8500.
