Headshots left to right: Jim Arrigo and Scott Pointner.

Rathje Woodward LLC Member Scott Pointner and Of Counsel Jim Arrigo present “Real Estate Law Refresher: Two Heads Are Better Than One: Ten Places Where Real Estate Law and Condo/HOA Law Intersect” a MCLE Remote Program to the DuPage County Bar Association on Thursday, June 10, 2021.

Real estate attorneys know the 7.0 Multi-Board Contract well, but many know very little about the inner workings of condominiums and common interest community associations (HOA’s). In this lecture, Jim Arrigo and Scott Pointner will explore ten places where residential real estate law and condo/HOA law intersect.

Jim Arrigo will explore five key issues in Condo/HOA law that too many real estate practitioners could not explain to their clients if asked at the closing table. Scott Pointner will explain five additional places where real estate law and Condo/HOA law intersect with surprisingly regularity.

Topics will involve extensive deep dives into Sections 9 and 15 of the 7.0 Multi-Board Contract, including: 1) Paid Assessment Letters; 2) Title Exceptions related to associations’ restrictions; 3) proposed special assessments; 4) charges for PAL’s; 5) legal descriptions of property being conveyed; 6) handling accumulated reserves; 7) statutes to know when your clients ask about buying or selling a condo or CICA unit; 8) surveys; 9) taking title; and 10) confirmed special assessments.

What You Will Learn By Attending This Presentation:
1. Real Estate attorneys will leave the presentation understanding much more about Condo/HOA law, and will be able to better answer Condo/HOA questions from their clients.

2. Condo/HOA attorneys will leave the presentation understanding much more about residential closings, and will have a better understanding of where many questions arise from real estate attorneys.
